Since we're trying to build local community, and we've run up against a sticky wicket, I thought I'd steal a page from one of the masters of building local online communities: When Craigslist runs into a dilemma about how to handle a business decision, they seek advice from the community.
So here's ours: One of the cooler features of our site is the live performances (both audio and video). Cindy and Alex, in particular, log countless hours and miles to deliver audio and video of local bands -- many of whom have no other live material available online.
This is, of course, always done with the permission of the band. However, we're increasingly running into a situation where the band comes back after the fact and asks us to remove the material because THEY are unhappy with their performance.
I can see two sides to this. On the one hand, it costs us time (and therefore money) to record a show. And yeah, if we make the Rolling Stones sound like Britney Spears through some audio flub-up, I get it. But we can't afford to go record a band multiple times until they hit their height of performance. This is the costliest content we produce -- and we can't take a throw-away lightly. Bands don't get do-overs on live TV shows and radio performances, so why here?
On the other hand, we respect an artist's right to have say over how their music is used. And we've had cases where artists told us we could use studio mp3s and changed their minds -- and we took 'em down without thinking twice. We're about helping get more people out to more shows, so we don't want "bad" material either. (The problem is that bad is in the ear of the beholder.)
Where I think I come down on this is that as long as the recording can reasonably be considered good and useful to our users, than it should stay.
But, we don't know it all, by a long stretch. And according to our user registrations, more than 1/3 of you are in bands. So what do you think?
One final note-- I'm not picking on any one band here. This has cropped up several times.

It depends on how seriously you want to be taken as a news site. If you're just a promotional site for musicians, that's fine, but letting them dictate your site's content sets a precedent. What happens if they say something they later regret during an interview and ask you to remove the interview from your site?

man im not saying this just to be saying it but if u say it you almost have to stand by it especially on film or mp3 now if it was text all yall would have to do is remove it. Im not gone lie ive done interviews and said man why did I say that or why did I do that like that but i be like oh well guess i got to stick with it. So as artist if u dont like the way u sound live dont do it or get yo skills up thats why I dont freestyle no more unless im in a show setting or im really really feeling the moment cause it could suck and that will be the time when you get recorded........ and also you have to learn how to loosen up as a artist... i try my best not to do or say stuff that I really dont mean that way if I do or say it no matter how outlandish it may be I can say hey thats how I felt when I did it.

If we have studio mp3's of a band on the site and they want them removed for any reason at any time, we'll do that -- no questions asked. That's been our policy from day one. The issue we're struggling with is when we invest the time and money to record a show ourselves, with the band's permission.
We're coming up with an answer that we think is fair to everyone, and will post a policy soon (hopefully later today), so that on a go-forward basis everyone is reading from the same playbook. Thanks for all the support and input.

I think there could be extenuating circumstances for the band: someone's sick (which should absolutely require a prior call to Cindy and Alex- "Hey, please, don't come, we don't want to waste your time."), they got a crap soundguy, equipment malfunction, etc. In that case, I think there should be some leniency. But if they just feel they didn't do their best, well, that's life. Do better next time. If they are part of a big show, like the Wall of Sound, etc., then, well, do better next time.
Having TexasGigs recording your show may not be exactly like being on Jay Leno, but the bands who are serious about the business of music treat it as such. Every concert, every audience counts. Better to learn that right now.
