City of Duncanville sued by swingers club
The owner of the Cherry Pit is coming out swinging -- and not in the fun way. Almost a month after being forced to close down due to a new Duncanville ordinance, Jim Trulock has sued the city, saying there's no "constitutionally acceptable" grounds to enforce the ordinance, and also, as one of our users astutely pointed out, the ordinance is so vague that a husband and wife could be prosecuted for trying to have sex with each other.

Attorneys for The Cherry Pit said their case, in part, is backed by the 2003 U.S. Supreme Court decision in Lawrence v. Texas, which upheld sexual privacy protections in striking down sodomy as a crime in the state.
The legality of private sodomy means you can publicize your house as a sex club? Bit of a reach on that one. I like sex as much as <a href="http://www.pegasusnews.com/blogs/pegasusnewsblog/2007/dec/07/i-enjoy-sex-sexually/">Roger Staubach</a>, but seriously...
