$5.1 million settlement reached in fatal Easter Sunday truck crash
FORT WORTH The Law Offices of John David Hart of Fort Worth announced today that they have negotiated a settlement of the lawsuit resulting from an 18-wheeler truck crash on Easter Sunday, 2007. The defendants agreed to pay $5.1 million to settle the case.
According to the suit, on April 8, 2007, 50-year-old Penny Sue Thompson was driving a vehicle with her two grandchildren, Aubrey Nicole Moore, 6, and Dylan Glenn Moore, 10. Larry Dean Roberts, 53, was driving a tractor-trailer. According to police reports, the two vehicles collided when Roberts failed to stop at a stop sign. As a result, both Aubrey Moore and Penny Thompson died; Dylan Moore was severely injured.
Mr. Hart and Mr. Boulware represented the children's parents Corey and Lisa Moore of Cleburne, Texas, in a wrongful death and serious injury lawsuit against Joe Swinson of Swinson Excavating, Stoney Point Agricorp., Inc., and truck driver Roberts. Of the $5.1 million settlement, $425,000 was paid to other family members of Penny Sue Thompson who intervened in the lawsuit.
Roberts told police investigators that he had been in a hurry and was talking to his dog when the crash occurred. Plaintiffs charged that the negligence of Roberts caused the crash that killed Aubrey Moore and Penny Thompson, and the severe injuries to Dylan Moore.
"Our goal from day one was to make sure that Dylan's long-term care needs were met and that Corey and Lisa's rights were protected," said attorney John David Hart of the Law Offices of John David Hart. "The devastating loss to these families demonstrates the vital importance of safe trucking on roads and highways."

Stoney Point AgriCorp, Inc had nothing to do with this accident, other than owning the trailer that the contract freight company was pulling. The freight company was responsibile for all maintenance and driver safety. Stoney Point was not liable, but had a large umbrella insurance policy that assisted in taking care of the victims.

The truck pictured was not the one driven by the contract freight comapny, Swinson Excavation. This is an inaccurate portrayal.
