Court rules for McKinney in dispute with Fairview

A court ruled that McKinney has jurisdictional authority over three tracts of land located south of Collin County Regional Airport.

A state appellate court last week upheld a Collin County district court’s ruling that McKinney has jurisdictional authority over three tracts of land located south of Collin County Regional Airport that have been the subject of a long-standing dispute between McKinney and Fairview.

Fairview had appealed a 296th District Court of Collin County judgment issued Sept. 20, 2006, ordering that McKinney's Ordinance 472, adopted in November 1958, established the boundary upon which McKinney's original jurisdiction was based. Finding Ordinance 472 valid in all respects, the district court further ruled that three tracts, each claimed by McKinney and Fairview, were within the jurisdictional authority of McKinney and any ordinance adopted by Fairview attempting to annex any part of the tracts was void.

McKinney and Fairview entered into an agreement in June 2006 establishing the location of the boundary line between them, with the exception of the three tracts. The Court of Appeals’ decision will complete the boundary line. McKinney officials are pleased with the ruling.

"The Court of Appeals, like the District Court, made the correct decision," said McKinney Mayor Bill Whitfield. "McKinney filed this lawsuit over eight years ago to protect its jurisdiction over this area. While the case has made its way through the courts, we have continued working on development initiatives, including the Collin County Regional Airport and the economic opportunities the airport brings. With this ruling, McKinney and Fairview can formalize the complete boundary line and hopefully move forward to work together for the benefit of the residents and businesses in the region."
