Dump truck driver indicted in death of McKinney woman

MCKINNEY Alberto Espinosa, of Plano, was indicted by a Collin County grand jury Tuesday of criminally negligent homicide according to court documents filed in the 380th District Court of Judge Charles Sandoval.
Criminally negligent homicide is defined as causing the death of an individual by criminal negligence. The offense is a state jail felony, a sentence which normally carries with it a probated sentence. It should be noted, however, that judges have at their discretion the ability to sentence offenders to up to two years in a state jail.
The case stems from the April 30, 2007 motor vehicle accident which claimed the life of McKinney resident LeAnn Selkirk. At approximately 7:05 a.m. Selkirk, who was southbound on 400 N. Custer Rd., was stopped, her gold Infinity QX4 preparing to make a left turn into Sonic. Moments later, a commercial dump truck driven by Espinosa crashed into her. Selkirk was dead at the scene, crushed by the weight of the overturned dump truck/semi-trailer tandem.
The commercial dump truck was driven by Espinosa, 28. The case was turned over to the grand jury on Dec. 10 following an investigation by the McKinney Police Department and a separate investigation of Espinosa's vehicle by the Texas Department of Public Safety. MPD noted faulty evasive action and defective brakes on the dump truck/trailer tandem driven by Espinosa, as key contributors to the accident. The accident report indicated a “partially inoperable braking system which contributed to the cause of the accident.”
Selkirk, 26, was pregnant at the time of her death. She was a kindergarten teacher in Anna.
