UPDATED: Questions raised, lawsuits filed, over funds marked for local-music foundation in Dallas

— On Thursday afternoon, the following email came into Pegasus News:

Friends,

Today a lawsuit has been filed against Ally David and Bend Studio (with business locations in Dallas, Austin, Fort Worth) for misappropriation of thousands of dollars from the Anju Gill Foundation. Several well known musicians and the foundation have filed the suit. Anju Gill was a part of the local music community and sadly, she passed away in 2006 and her parents gave $10,000 to start something in her honor. Then there were fundraisers held in her honor as well at Bend Studio, raising money for this cause. Anyway, the story is of note because of the manner in which the funds have magically disappeared and also the public role Ally David and Bend Studio have played in the local music community.

Also worth noting are the multiple fund-raisers Ms. David held to raise money for a surgery that she has not received as of this date. I think this is a story that needs to be told and an injustice that needs to have light shed on it. The lawsuit has been filed at the Dallas County Courthouse and you'll recognize some well-known musicians who are part of the suit against David. Also, you might want to pay attention to a ridiculous countersuit for $1million Ms. David has filed in return. You can do your thing from there and write the story, but I hope you’ll all pay attention to it as no one has anything to gain other than trying to right a wrong of someone taking money from charity for seemingly personal gain and then refusing to work at correcting it. It will come into light and I thought you guys should know first. I will say I am not a part of this suit and so have no vested interest other than the music community and only pass this information as a friend. You'll want to do some digging.

Anju Gill was a big music fan who attended many local shows and supported bands so fervently that she earned a place in many musicians' hearts.

"In the singer-songwriter world inhabited by myself and Chris Holt and Trey Johnson and Salim Nourallah, the bread and butter is connection with the individual in audience," says musician Rahim Quazi. "So when an Anju Gill comes along that stands in front and watches you and sings along on every word, and from such a pure place... she was a true fan of the live song being sung, and had no inhibitions about expressing her gratitude towards the people she would go and see."

In April 2006, Gill killed herself. A year later, with the $10,000 stake from her family, the Anju Gill Foundation was created, to "preserve and perpetuate Anju's love and support of the local music scene and the artists who contribute to it in her name".

A board was created with musicians (Salim, Rahim, plus Salim's wife Jayme) and business-types (Diana Bacon, Sara Blanton) who ostensibly knew how to deal with foundations and funds. A source says that the $10K check, co-addressed to Bend Studio and Jayme Nourallah was then given to Bend owner Ally David.

The first event was on May 19, 2007, "An Intimate Evening with Salim Nourallah and Rahim Quazi". The most recent Anju benefit took place on September 3, which also memorialized the one-year anniversary of Carter Albrecht's death.

After the September 3 memorial, Salim Nourallah posted an entry on his blog expressing his doubts about the disposition of the Anju Gill Foundation monies (noted, then deleted on Salim's request, by Cindy Chaffin).

Today, the lawsuits ensued: One filed by the Anju Gill Foundation against David and Bend Studio for misuse of the funds; and another for $1.5 million filed by David for "defamation of character".

The musicians involved can't discuss what happened, while David said, "It’s a complete lie. I can’t talk about it."

But meanwhile, the foundation fund-raising events will go on, with two showcases coming up: one on October 2 at Club Dada with Philip Creamer and Sammy Strittmatter, followed by a multi-band showcase on November 15.

UPDATE: DC9 obtained the case documents for the dueling lawsuits between the Anju Gill Foundation and Ally David/Bend Studio, as follows:

Here is a copy of the lawsuit filed by Ally David/Bend Studio against Salim Nourallah. ("For a period of time, Defendant has made statements to the effect that the Plaintiff was a thief, a con artist, a scammer and misappropriated a substantial sum of money that was raised and/or donated to an unincorporated entity concerning Anju Gill, Deceased. ... In particular, the Defendant stated, in relevant parts in his web Blog and elsewhere that he is concerned with the whereabouts of a substantial sum of money that was raised and/or donated to the Anju Gill Fund ")

Here is a copy of the lawsuit filed by the Anju Gill Foundation (AGF) against Ally David/Bend Studio. ("AGF recently requested an accounting of the funds entrusted to Ally David's care and responsibility. After several attempts to obtain information from her about the funds raised for the AGF, Ally David admitted that she spent the funds.")

I am not surprised by this. Although I have no direct proof of Ally misusing funds I have heard such rumors before about other "fundraising" events.

Its a sad state of affairs when a foundation wastes earmarked funds for their own self-gain. I dont know if the claims are true or not, but its still disturbing to read a story of this nature...

OK, tad off topic, but I'm still whining about the CD I paid $20 for at Bend for the performance I attended that night. Never got it. And what a bummer, my voice is on there asking the performer a question!

Closest I'm getting to being on a CD - forget the $20! I wanted my 15 seconds of fame!

littlekinder, speaking of CD sales, today i visited Bend Studio's <a href="http://www.bendstudio.com/merch.htm">merchandise sales</a> page (which has since been scrubbed), and noted that a number of the CDs had proceeds earmarked for charities such as "victims from Hurricane Katrina" and <a href="http://www.familyplace.org/NETCOMMUNITY/Page.aspx?pid=191&amp;srcid=-2">The Family Place</a>. it's hard to track down "victims from Hurricane Katrina", but the Family Place has an office and a phone. So i called them and was told they'd never received any money from any CD sales from Bend. this was at 12 noon today; unfortunately, Bend's merchandise page now has an Error message.

... What a freakin' mess and a horrible waste of time and energy. I think both parties should settle their differences by each agreeing to drop their lawsuits. I'm not saying there is nothing to be angry or disturbed about, or an injustice did or did not occur. I'm just saying that sometimes you have to admit to yourself and or to one another, on a friendly basis, that mistakes were made and then ... just ... let ... it ... go-o-o-o. "Things" have a way of taking care of themselves. You must give in to that notion or you will continue to be miserable. As you all know, artists do not function well amidst a sea of negative waves. So, carry on.
