Proposed Dallas daytime curfew - who are you kidding?

I’ve mentioned the proposed Dallas daytime curfew for those under 18 during school hours. Even though police already have the power to take truants into custody, this new curfew would criminalize them and — big surprise here — slap a $500 fine on parents. I’m sure it has nothing to do with Dallas’ budget crisis. Anyway, here’s more on the issue from the Citizens Against a Daytime Curfew. Take it away, Laurel Allen.

Is the proposed daytime curfew necessary?

According to the Texas Education Code, police are already fully empowered to take any child seen in public during school hours into custody in order to determine if they are a juvenile in need of supervision, or if there is probable cause that they are in violation of the compulsory school attendance law under Section 25 of the code. In the process of making that determination, they have the ability to intervene in a manner that requires the involvement of the child’s parent or guardian, the courts or juvenile board, and the school district.

Under the proposed Dallas daytime curfew, a child may be issued a class C misdemeanor with a fine of up to $500 merely for being outside during the hours of 9:00 a.m. - 2:30 p.m. when school is in session. Parents or guardians may also be cited if their child is in violation of the curfew. In addition, the owner, operator, or any employee of an establishment may be fined if he permits a minor to remain upon the premises of the establishment during curfew hours.

There are no exceptions; rather, there are “defenses to prosecution.” For example, it is a defense to prosecution if a youth is going to or returning from a school-approved work study program, but only without any detour or stop. Translated, this means that your 16 year old may go to and from his work study program, but he stops at a convenience store during curfew hours for a snack on his way to his work study program, you, your child, and the convenience store employee that rings up his purchase are all breaking the curfew and could each be issued a class C misdemeanor with a fine of $500.

To quote Michael Tate, Commentator for KERA, “The notion of a daytime curfew just doesn’t make good sense. It misplaces responsibility and doesn’t address any of the underlying problems that cause a teenager to bail out of their education. Nor does it stop a kid from being a criminal, because it criminalizes them before they’ve committed a real crime.”

Contact Mayor Leppert and your city council person and ask them to vote AGAINST the daytime curfew. The final public hearing is on May 13 at Dallas City Hall, after which the Dallas City Council will cast its vote.

This is another fine example of the jackasses at dalass city hall looking for any excuse to make money, short of raising business taxes. Is this city THAT despirate for revenue to prosecute and fine a parent 500 bucks that they probably dont have? Theres laws on the books already that arent being used in their full and total effectiveness.

Most of the truancy issues are due to the fact DISD is a lousy school district to begin with. Apperantly they dont engage intelligent kids anymore, only teaching TAKS to the lowest hanging moronic fruit on the tree, the same people you see stocking at Target or the McDonalds drive-up window asking if you want fries. The main issue at hand is the district not engaging the students who have a thirst for knowledge, instead catering to their lesser peers. Fixing the schools is only one part of this, another is getting parents of said low hanging fruit involved w/ their education, inspire them, make them realize they can become better than their said parent(s) and quit relying on the schools to raise their kids as a whole.

Naw, I have both liberal and conservative slants on various issue, I consider myself more of a middle of the roader like most Americans. On DISD, Im like everyone else. I agree this is a total disaster that needs to be dismantled and spun off into smaller, more managable neighborhood/regional districts, each w/ a board of local peers and a super to run their affairs.

I also think we need to get back to teaching kids the three r's, music and the arts. TAKS and other tests of their ilk have severely decimated the teaching ranks and replaced them w/ people who are there to pull a paycheck. Lastly, Its time parents get off their duff and get more involved w/ their childs education. Im not talking helicopter parents, but parents who'll allow their kids to make mistakes and teach them to learn from them..

As much as I agree with you, you must realize that most of the parents that you want to take interest in the children’s education are more than likely school drop outs and useless members of society themselves. These are the dregs that got knocked up and decided to live off the state/government teat, collecting their checks and not really even trying to improve their situation. I have no kids so I really have no right to speak upon this, but I am a firm believer of imposed sterilization. Only cause Darwinism is a little slower than I like.

Not that I'm saying Chris is wrong - parents absolutely should get involved with education. But that's kind of an aside from the topic at hand, which will hopefully evolve into whether we'll be able to collect bounties by trapping roaming teenagers and returning them to the police department, or possibly selling their furs to English settlers.

Pavel, how much per pelt? I was going to do something similar w/ the bums downtown and in ellum. Im using a malt liquor and fried bologna-based trap system,but had limited success so far. Maybe we should combine our resources and go into business.

Iran into a Dallas cop today, he thought I was a kid not going to school, when he saw me he ran or drove away, he was not a real Dallas cop,he was a hired cop or contractor from another state...I Suspect..

Then I realize, the Mayor has 4 body guards and he is like running this whole thing,kind of like Al Capone of Chicago only he is the Mayor of West of the Trinity, beginning where the New Hotel will be built and the clean up of West Dallas, so...no kids,no cops..no hotel..A/T, BLIND MAN WALTZ...
