Possible “sexting” incident causes stir at Dallas elementary school
A 12-year-old boy had his cell phone confiscated when it kept buzzing during a test in a class at Wallace Elementary School in the Lake Highlands neighborhood of Dallas. (Confusingly, it is also in the Richardson Independent School District - but who's counting?)
When his teacher looked at the text messages on the boy's phone, she discovered nude pictures of what seemed to be an underage girl.
If it's discovered that the girl pictured is underage, the boy would face child pornography charges; if it's also determined that the girl sent her pictures to the boy (in a practice known colloquially as "sexting"), she could be charged with distributing.

So, below 18 it's a felony...18+ it's just slutty? Doing a bang-up job!
Granted, Shook seems to be the voice of reason: *"The greater question is, should the law change in regard to juveniles? Is this really the intent of the Legislature?" he said. "I think not."*

The kids are stupid for sexting. So not to be outdone, lawmakers write laws to make kids felons and sex offenders at age 12. This kids life is ruined at age 12 for having a nude or seminude photo of someone close to his age. Is this fair and reasonable punishment for a 5th or 6th grader?

If they are both 12 or thereabouts, this shouldn't even be a police matter. Back in the day if a couple of kids got caught giving each other a peek, their parents got called. Typically it resulted in a lot of yelling followed by no social life for a long period of time.

How in the hell is a 12yo looking at a 12yo child pornography?? Maybe in a semantic sense, but not in the sense that protects children from old pre-verts. And what if they're 17 & 364 days? Felony!! They can become a smoking stripper and kill people for Uncle Sam the next day though, right? Oh what a twisted maze we navigate... C.H... Concerned Parent
